This “Terms and Conditions” is formulated to protect the rights of Customer and Member, to ensure the rights and obligations between Customer, Member, “Wai Ji Hong Yip Co., Ltd.” (hereinafter referred to as "Wai Ji Hong Yip", “we” and “us”) and our Website www.wjhy.com.hk (hereinafter referred to as "Website"), and to regulate the behaviours of all parties.

 

2. Definitions

2.1.     Customer: all persons who visit and use the e-commerce service of our Website.

2.2.     Member: all persons who successfully registered and become a Member of our Website by providing his/her personal information.

2.3.     Login ID: the account name set up by the Member to verify his/her identity when using our online purchase services.

2.4.     Password: the combination of letters, numbers or symbols set up by the Member to ensure the safety of his/her account information.

5. Force Majeure

5.1.     "Force Majeure" means an event that “Wai Ji Hong Yip” and our Website can't foresee, avoid or overcome, including but not limited to government actions, natural disasters, bad weather, war, hacking, computer viruses, and network failure.

5.2.     “Wai Ji Hong Yip” and our Website may suspend the obligations under the “Terms and Conditions” until the effect of force majeure event is gone. We and our Website shall not be liable to the Customer, Member or any third parties for the breach of agreement.

 

6. Registration

6.1.     We will not charge the Customer for registration fee.

6.2.     If your registration is unsuccessful, it may be one of the following cases:

A.     Membership has been disqualified under Section 7, Paragraph 3 of the “Terms and Conditions”.

B.     Account information contains false, malicious or other illegal content.

6.3.     Member must provide the latest, complete, accurate and true account information. If any account information does not comply with the requirements, “Wai Ji Hong Yip” and our Website reserve the right to suspend or terminate the relevant registration without any liabilities to the Member or any third parties.

6.4.     Member must update his/her account information on our Website in a timely manner. The account information must be the latest, complete, accurate and true so as to avoid delay in goods delivery and services.

 

7. Suspension or Termination of Membership and Services

7.1.     Member is entitled to terminate his/her membership at any time.

7.2.     If any of the following occurs, “Wai Ji Hong Yip” and our Website reserve the right to suspend or terminate the membership immediately:

A.     Violating the “Terms and Conditions”.

B.     Account information contains false or malicious content.

C.     Causing any form of damage or threat to the interests of “Wai Ji Hong Yip” or our Website when using our services.

D.     Violating of the laws of Hong Kong, and endangering the country and legitimate rights of the public.

E.     Using account information as a commodity to exchange, trade, or sell without our written permission.

F.      Reprinting, leaking, and distributing account information and causing serious impact on the others.

G.    Stealing others' account information, or interrupting others to use our Website's services.

H.    Failing to settle the online shopping payment or service fees on time.

7.3.     If the Member repeats violating or refuses to correct his/her behaviour within 7 days after suspension, we reserve the right to terminate his/her membership and not to provide any services in sole discretion. “Wai Ji Hong Yip” and our Website are not liable for any losses arising thereafter.

 

8. Notification and Business Information

8.1.     We will send out various types of notices to the Member by Emails.

8.2.     The “Terms and Conditions” and the contents of our Website are subjected to change without prior notice. Customer shall read and accept the effective “Terms and Conditions” at the time before browsing our Website, purchasing our Product or using our e-commerce services.

8.3.     Without disclosing privacy data, we reserve the right to distribute business information to the Member.

 

9. Payment

9.1.     We accept “PayPal” only. Member is required to become a “PayPal” member before purchasing. (Please refer to PayPal's official website at www.paypal.com)

9.2.     When you choose your payment method, please select "PayPal”, enter your PayPal ID and password, and confirm your payment by PayPal's verification.

9.3.     When you select to pay by “PayPal”, all information of transaction is processed and encrypted by “PayPal”. Please refer to PayPal's official website for further information.

9.4.     If customer want to pay in cash, you need to contact our customer service officers to confirm the order, and pay the goods in cash when picking them up at our designated branch.

 

10. Prices, Trade and Goods Delivery

10.1.     The prices listed on our Website are effective at the time. We reserve the right to edit without prior notice.

10.2.     The pictures, colors and conditions of the products listed on this website are for reference only, and all the actual conditions after the goods are shipped shall prevail.

10.3.     The ownership and risk of the Product are transferred to the buyer after the Product is delivered or self-picked up.

10.4.     We offer Hong Kong local delivery services only.

 

11. Returns and Replacements

11.1.     For the return of goods caused by us (such as wrong delivery, broken goods, shortage, quality problem, etc.), please contact us within 3 days after receipt. After investigation, we will replace the goods under the same or equivalent value for the Member. Our staff will provide the information of arrangement.

11.2.     We refuse to accept the request of return from the buyer with the reason of, including but not limited to outdated account information, wrong order, inaccurate verification of order confirmation, and change of purchase intention.

 

12. Account and Password

12.1.     The Login ID and Password of our Website are the warrant from the Member for using our services, online shopping, transactions, and after-sales services. Member is obliged to keep his/her Login ID and Password in safe custody.

12.2.     Member is not allowed to transfer or authorize others to use his/her Login ID and Password by any means whatsoever. If Login ID and Password were copied or stolen, the Member would be liable to all the losses caused by his/her mismanagement.

12.3.     No one is allowed to use any improper or illegal means to steal others' account information or to harass others. If you are having the foresaid problems, please contact us immediately.

 

13. The Codes of Conduct for Customer and Member

Customer and Member must comply with the relevant policies and the laws of Hong Kong and abide the following rules when using our e-commerce services:

13.1.     Do not use false information, impersonation or third parties' information to apply and register as our Member, or make any improper changes to the account information.

13.2.     Do not use any improper or illegal means to steal the account information from others or to harass others.

13.3.     Do not lease, sell, transfer or authorize others to use his/her account by any means.

13.4.     Do not improperly distribute and release any information by any means that may cause adversely influence on the operation of “Wai Ji Hong Yip” and our Website.

13.5.     Do not infringe, including but not limited to improperly copy, edit and distribute, the intellectual property rights of “Wai Ji Hong Yip” and our Website by any means.

13.6.     Do not use any devices, software, or network services to do anything detrimental to “Wai Ji Hong Yip” and our Website.

 

14. Intellectual Property

14.1.     “Wai Ji Hong Yip” has the absolute and complete ownership and intellectual property rights of the entire contents of our Website or has obtained the legal authority from the third parties, including but not limited to patents, trademarks, designs, copyrights, texts, pictures, charts, photos, software, sounds, videos, advertisements, and all types of information on our Website. All rights, ownership and interests attaching to the intellectual property rights of the above contents are properties owned by “Wai Ji Hong Yip” or the third parties at any time.

14.2.     No one shall, without a written permission from “Wai Ji Hong Yip”, infringe the contents of our Website by any means, including but not limited to copying, modifying, downloading, transmitting, publishing, printing, and distributing. “Wai Ji Hong Yip” reserve the right to pursue the matter in court once discovered.

 

15. Disclaimer

15.1.     Member is not allowed to transfer or authorize others to use his/her Login ID and Password of our Website by any means. Member shall be responsible for the consequential loss caused by account mismanagement, including Login ID and Password are being copied or stolen. In the meantime, “Wai Ji Hong Yip” and our Website will not be liable for all the activities and responsibilities arising from the foresaid account.

15.2.     Customer and Member understand that service interruption can occur, which may be caused by force majeure, technical issue, network, and signal errors. “Wai Ji Hong Yip” and our Website will not guarantee or accept any responsibilities on the aforesaid.

 

16. Final Decision

In the event of any dispute, “Wai Ji Hong Yip” reserves the right of final decision.

 

17. Prevailing Language

In the event of any discrepancy in the translation of this text, the Chinese version shall prevail.

 

18. Applicable Law

The “Terms and Conditions” are governed by the laws of the Hong Kong Special Administrative Region, and Customer, Member, “Wai Ji Hong Yip” and our Website agree to submit to the jurisdiction of the Hong Kong courts.
